TERMS OF SERVICE

SCOPE

 These terms and conditions of COSYSPEED GmbH apply to all contracts that a consumer or entrepreneur concludes with the seller with regard to the goods and / or services presented by the seller in his online shop or otherwise. We hereby object to the inclusion of the customer's own terms, unless otherwise agreed.

 
1. Formation of the contract

 With your order you submit a binding offer to us to conclude a contract with you. We can accept this offer by sending you an order confirmation by email or by delivering the ordered goods. First of all, you will receive a confirmation of the receipt of your order by email to the email address you provided (order confirmation). However, a purchase contract is only concluded when you send our order confirmation by email to you in accordance with the attached general terms and conditions of COSYSPEED GmbH.

 

 When ordering from our online shop, the order process comprises a total of [XX] steps. In the first step you select the desired goods. In the second step, you enter your customer data including the billing address and, if applicable, a different delivery address. In the third step you choose how you want to pay. In the last step, you have the opportunity to check all details (e.g. name, address, form of payment, ordered items) again and correct them if necessary before you send your order to us by clicking on 'Send order'.

 
2. Storage of the contract text

 We save the contract text of your order. You can print this out before sending your order to us by clicking on "Print" in the last step of the order. We will also send you an order and order confirmation with all order details and our general terms and conditions to the email address you provided.

 
3. Retention of title

 The delivered goods remain our property until all claims have been paid in full.

4. Prices, shipping costs, return shipping costs if canceled

 All prices are final prices, they include VAT. The shipping costs for orders via our online shop are per order:

 

 Within Germany: 7.00 EUR
Within the EU: 19.00 EUR
Worldwide: 19.00 EUR

 

If you make use of an existing right of cancellation, you have to bear the regular costs of the return if the delivered goods correspond to the ordered ones and if the price of the item to be returned does not exceed an amount of 40 euros or if you at a higher price of the item Have not yet rendered the consideration or a contractually agreed installment. Otherwise, the return is free for you.
 

5. Delivery conditions

Unless otherwise stated in the offer, we will dispatch the goods within 2 working days after receipt of payment. For delivery on account or payment by direct debit, unless otherwise stated in the offer, we will ship the goods within 2 working days after delivery of the order confirmation.

6. Payment

Payment can be made either in advance by bank transfer, by credit card or by direct debit. We reserve the right to exclude individual payment methods. If you choose the payment method prepayment, we will give you the bank details in the order confirmation. The invoice amount must be transferred to our account within 10 days. You can only exercise a right of retention if the claims result from the same contractual relationship.

7. warranty

The guarantee for consumer contracts is based on the statutory provisions, with the exception of the limitation period. In deviation from § 438 BGB, the warranty period is 1 year from receipt of the goods.

 

 If the customer is a dealer / entrepreneur and not a consumer, the warranty period for the purchase of newly manufactured items is 1 year from delivery of the goods and if used goods are the subject of the purchase contract, the statutory warranty is completely excluded.

8. Data protection

 When initiating, concluding, processing and reversing a purchase contract, we collect, save and process data in accordance with the statutory provisions.
 
When you visit our website, the IP address currently used by your PC, the date and time, the browser type and the operating system of your PC as well as the pages you are viewing are logged. However, we are not able to draw any conclusions about personal data, nor are we intending to.
 
The personal data that you give us e.g. B. when ordering or by email (e.g. your name and contact details) will only be processed for correspondence with you and only for the purpose for which you have provided us with the data. We only pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. In order to process payments, we pass on your payment details to the bank responsible for the payment.
 
We assure that we will not otherwise pass on your personal data to third parties, unless we are legally obliged to do so or you have given your express prior consent. Insofar as we use third-party services for the implementation and processing of processing processes, the provisions of the Federal Data Protection Act are observed.
 
Duration of storage
Personal data that have been communicated to us via our website will only be stored until the purpose for which they were entrusted to us is fulfilled. Insofar as commercial and tax retention periods must be observed, the duration of the storage of certain data can be up to 10 years.

Should individual provisions of these general terms and conditions be legally ineffective, the legal validity of the remaining provisions will not be affected.
